Processing of personal data

I. Basic Provisions

    1. The controller of personal data according to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – “GDPR”) is Pletemesi.cz s.r.o., Company ID: 19316712, with registered office at Cihelní 668/1, Karviná, 73506, Czech Republic (hereinafter referred to as the “controller”).

    3. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
    4. The controller has not appointed a data protection officer.

II. Sources and Categories of Processed Personal Data

    1. The controller processes personal data that you have provided or personal data that the controller has obtained in connection with the fulfillment of your order.
    2. The controller processes your identification and contact details and data necessary for the performance of the contract.

III. Legal Grounds and Purpose of Personal Data Processing

    1. The legal grounds for processing personal data are:
• performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR,
• legitimate interest of the controller in direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
• your consent to the processing for direct marketing purposes (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in connection with Section 7(2) of Act No. 480/2004 Coll., on certain services of the information society, in the event that no order has been placed.
    2. The purpose of processing personal data is:
• to process your order and exercise the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for successful fulfillment (name, address, contact details) are required – providing personal data is a necessary requirement for concluding and fulfilling the contract, and without it, the contract cannot be concluded or fulfilled by the controller,
• sending commercial communications and conducting other marketing activities.
    3. The controller does not engage in automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.

IV. Data Retention Period

    1. The controller stores personal data:
• for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years from the termination of the contractual relationship),
• until consent to the processing for marketing purposes is withdrawn, but no longer than 3 years if the processing is based on consent.
    2. After the retention period has expired, the controller deletes the personal data.

V. Recipients of Personal Data (Controller"s Subcontractors)

    1. Recipients of personal data are persons:
• involved in the delivery of goods/services/payment processing based on the contract,
• providing e-shop operation services and other services related to the operation of the e-shop,
• providing marketing services.
    2. The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries include providers of mailing and cloud services.

VI. Your Rights

    1. Under the conditions set out in the GDPR, you have:
• the right to access your personal data pursuant to Article 15 GDPR,
• the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,
• the right to erasure of personal data pursuant to Article 17 GDPR,
• the right to object to processing pursuant to Article 21 GDPR,
• the right to data portability pursuant to Article 20 GDPR,
• the right to withdraw consent in writing or electronically to the controller’s address or email listed in Article III of these terms.
    2. You also have the right to lodge a complaint with the Data Protection Authority if you believe that your data protection rights have been violated.

VII. Security of Personal Data

    1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
    2. The controller has implemented technical measures to secure data storage and storage of personal data in physical form, including antivirus protection, passwords, HTTPS protocol, etc.
    3. The controller declares that only authorized persons have access to the personal data.

VIII. Final Provisions

    1. By submitting an order via the online order form, you confirm that you are familiar with the privacy policy and that you fully accept it.

    3. The controller is entitled to change these terms. The new version of the privacy policy will be published on the controller"s website and will also be sent to your email address provided to the controller.
